As long as it wasn't the same engine or script, but the same game in most ways, they're in the clear. Remember that Nintendo always tries to have this "family-friendly" image so a COD-inspired game isn't something they'd consider. Yes they have both Skyrim and Witcher 3 on their systems, which are both not kiddie games. And both are rated M for mature. A bit ironic, but considering that they're fantasy games, that could have played a role in their decision. I'm sure the Switch version is a watered down version of the actual games for several reasons. CPU capabilities being one. Nintendo's ridiculous demands being another.
